These Terms of Service are a binding agreement between you and SimplePeek. By creating a SimplePeek account, starting a free trial, or otherwise using the service, you agree to these Terms, our Privacy Policy, Refund Policy, Acceptable Use Policy, and DMCA Notice. If you do not agree to all of them, do not use SimplePeek. If you register a domain through us, our Domain Registration Agreement also applies.
You must be at least 18 years old to create a SimplePeek account. If you are creating an account on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms, and the word “you” in this agreement refers to both you and that organization.
SimplePeek is a website builder. You can pick a template, edit a single business website, and publish it on a SimplePeek subdomain or, on the Pro plan, on a custom domain. We may add, remove, or change features at any time. We will give reasonable notice before removing a feature you actively rely on, but we do not guarantee any feature will remain available forever.
SimplePeek offers paid plans on monthly and annual billing intervals. Plan prices are listed on our Pricing page in U.S. dollars (USD). Applicable taxes are added at checkout where required by law. We may change plan pricing with at least 30 days' notice. Existing subscribers will be notified by email and will have the option to cancel before any new pricing applies to their renewal.
New SimplePeek accounts include a 14-day free trial. You can build, edit, and publish your site for the full trial period. Your card is not charged during the trial.
Your trial converts to a paid subscription automatically on day 15 unless you cancel before then. When the trial converts, your card is charged the standard rate of the plan and billing interval you chose. To avoid the charge, cancel from your billing dashboard before the end of day 14. We send a reminder email about three days before the trial ends so you have time to decide.
Paid subscriptions renew automatically at the end of each billing period (every month for monthly plans, every year for annual plans) until you cancel. The card on file is charged on the renewal date.
You can cancel at any time from the billing dashboard inside your account. When you cancel, your site stays live and editable through the end of the billing period you have already paid for, then access ends. We do not pro- rate refunds for unused time. Refund details are in our Refund Policy.
Payments are processed by Stripe. By subscribing or registering a domain through us, you authorize SimplePeek and Stripe to charge the payment method you provide for all amounts due, including renewals, until you cancel. You agree to keep payment information current, and you authorize us to retry failed charges in line with Stripe's standard dunning behavior. If a charge ultimately fails, we may suspend access to your site until the account is brought current.
Pro-plan subscribers can register a custom domain through SimplePeek as an optional add-on. Domain registration is governed by our Domain Registration Agreement in addition to these Terms. Domain fees are billed annually and are not refundable once a domain has been registered.
You retain all rights you have in the content you upload to SimplePeek (text, images, video, business information, and similar). You grant SimplePeek a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and adapt that content solely as needed to operate the service for you (for example, generating thumbnails, serving from our CDN, displaying your published site to your visitors).
You are solely responsible for your content. You represent that you have all rights necessary to upload it and that it does not violate any law or third-party right. We may remove content that we reasonably believe violates our Acceptable Use Policy or applicable law, with or without notice.
Use of SimplePeek must comply with our Acceptable Use Policy. The AUP describes prohibited content (including illegal, infringing, malicious, deceptive, and exploitative content) and prohibited conduct (including scraping, abuse, and circumvention of technical limits). Repeat or severe violations result in termination.
SimplePeek follows the DMCA notice and takedown procedure. If you believe content on SimplePeek infringes a copyright you own, see our DMCA Notice for how to send a notice. Repeat infringers will have their accounts terminated in appropriate circumstances.
You may delete your SimplePeek account at any time from the dashboard. When you do, your published site is taken offline immediately and your data is permanently deleted within 30 days, except for records we are required to keep for legal, tax, or fraud-prevention reasons.
We may suspend or terminate your account if you violate these Terms or our AUP, if you fail to pay amounts due, if your account remains inactive for an extended period, or if we are required to by law. We will give notice when we reasonably can. Termination for a violation does not entitle you to a refund of fees already paid.
SimplePeek is provided on an “as is” and “as available” basis. We work hard to keep the service running but we do not guarantee any specific uptime, performance level, or that the service will be uninterrupted or error-free. Planned maintenance is announced in advance where practical.
To the fullest extent allowed by law, SimplePeek disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements or that any content displayed through the service is accurate, current, or reliable.
To the fullest extent allowed by law, SimplePeek and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of or related to these Terms or the service is limited to the amount you paid SimplePeek in the 12 months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater.
You agree to defend, indemnify, and hold SimplePeek and its affiliates harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the service, your content, or your violation of these Terms.
These Terms are governed by the laws of the State of [State], United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the service must be brought in the state or federal courts located in [County], [State], and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we make a material change, we will give at least 30 days' notice by email or by posting a notice on our website. Your continued use of SimplePeek after the change takes effect means you accept the updated Terms. If you do not accept the updated Terms, you can cancel your subscription before they take effect.
These Terms are the entire agreement between you and SimplePeek about the service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
