DMCA Notice & Takedown Policy

1. Overview

SimplePeek respects intellectual property rights and follows the notice and takedown procedure of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. If you believe content hosted on SimplePeek infringes a copyright you own or are authorized to act for, you can submit a notice as described below. SimplePeek will respond as required by law.

2. How to Submit a Notice

Send your notice to our designated agent at dmca@simplepeek.com. Per 17 U.S.C. §512(c)(3), a valid notice must include all of the following:

  1. Your physical or electronic signature, or that of someone authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to be infringed. If multiple works at one site are involved, a representative list is fine.
  3. The URL or other identifying information of the material on SimplePeek that you claim is infringing, with enough detail for us to locate it.
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner of the exclusive right allegedly infringed or are authorized to act on the owner's behalf.

Knowingly making material misrepresentations in a DMCA notice can result in liability under 17 U.S.C. §512(f). Send only honest, well-supported claims.

3. Designated Agent

SimplePeek's designated DMCA agent receives notices at dmca@simplepeek.com. The agent is registered with the United States Copyright Office. Notices sent to other addresses may not be received in time to act on them.

4. What We Do When We Receive a Notice

When we receive a notice that complies with the DMCA, we will, in our discretion and as required by law:

  • Remove or disable access to the material identified in the notice.
  • Notify the SimplePeek customer who posted or hosted the material.
  • Forward the notice (including the sender's contact information) to that customer.
  • Keep a record of the notice and our response.

5. Counter-Notice

If you are a SimplePeek customer and you believe material of yours was removed or disabled in error or as a result of misidentification, you may file a counter-notice. Send it to dmca@simplepeek.com. Per 17 U.S.C. §512(g)(3), a counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location at which it appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which SimplePeek may be found, and that you will accept service of process from the person who provided the original notice.

When we receive a valid counter-notice, we will forward it to the original complaining party. Unless that party files an action seeking a court order within 10 to 14 business days of being forwarded the counter-notice, we may restore the removed or disabled material.

6. Repeat Infringer Policy

SimplePeek will, in appropriate circumstances and at our discretion, terminate accounts of customers who are repeat infringers of copyright. We consider a number of factors, including the number of valid notices received, the severity of the infringements, and the customer's response.

The DMCA covers copyright. For trademark, trade-secret, publicity-rights, or other intellectual property complaints, contact support@simplepeek.com with a detailed description of the claim and we will route it to the right team.
